Knocksense: A local content and recommendations platform

Online betting sites have taken the Indian market by storm. These days, it is a great way to enjoy and include viewers in sports matches, or competitions of any form. However, there are several grey areas about legality of betting sites in India.

While any form of gambling or betting is technically illegal, in certain safe zones, or safe websites, the laws can be twisted and turned in your favour. There are several safe websites and online spaces which offer legal betting services. In a state such as Goa, gambling is legal only in licensed offshore and on-shore casinos. There are very few other states which allow casinos, but the case with betting sites is a bit different.

Is online betting even legal?

The short answer is- Yes. There are no Federal laws against online betting in India. However, despite that, states are free to form their own rules and regulations against online betting, and some state governments can even ban the same if the need arises. The constitutional documents of India which were released in 1950, state the same regarding gambling.

According to Mr. Manoj Mishra, Senior Advocate in the Odisha State Bar Council, "The legal situation relating to using online betting sites in India is decidedly unclear. The Public Gaming Act of 1867 makes no reference to online betting."

As far as online betting is concerned, we need to look towards the gambling laws which first arose in the Constitution of India in 1950. It allowed states to set gambling laws, and since betting is an offspring of gambling (and also because the documents don't mention it), the same laws have been taken into consideration.

Which States allow it and which don't?

Here's where the main crux of the "states can form their own rules" lies. In states such as Sikkim, the local government aims to regulate online betting. They also strive to bring operators who can offer games in the state.

On the other hand, Tamil Nadu has no laws for or against the practice, making things slightly convoluted. On the whole however, it seems as though Maharashtra, Karnataka and very few others do not stand gambling online.

This is because Maharashtra has a law which states that "games of skill are allowed while games of luck are prohibited." The same is true for Karnataka and a few other states.

As things stand now, it appears that most Indian states with the exception of a few such as Maharashtra, Karnataka, Uttar Pradesh, West Bengal, Andhra Pradesh and a few others do not allow gambling of any form (which extends to online gambling).

How to get started using betting sites in a safe way
