On this note, did you know that under the Copyright Act 1957, a Public Performance License (PPL) must be obtained to play pre-recorded music in public places, irrespective of the establishment being commercial or non-commercial in nature. This Licence issued by PPL India strictly covers only on-ground usage of music. On-ground music basically includes recorded music that is played live through speakers at venues, public spaces, or any physical premise where individuals can directly experience the music in a real-world setting. 

Moreover, this license grants the Licensee a non-exclusive and non-transferable right to use the copyrighted sound recordings solely for on-ground activities. It expressly prohibits from sub-licensing and can be terminated in the event of any violation.

Phonographic Performance Ltd (PPL) vs. Kaamakazi Solution Pvt Ltd

It is pertinent to mention that in a recent judgement, Bombay High Court has passed an interim restraining order against Kaamakazi Solution Pvt Ltd, preventing them from playing copyrighted songs owned by Phonographic Performance Ltd (PPL) without a license. The suit in reference was filed by PPL against Kaamakazi based on a social media post proposed to play songs at a New Year event in Mumbai.
